Terms of Service

By creating an account or using the MyGumasta web app or Android app, you agree to these terms. If you don't agree, please don't use the service.

1. The service

MyGumasta provides a restaurant management platform — taking orders, tracking sales, computing profit, sending notifications, and customer engagement tools. The service is offered as-is and we may add or remove features over time.

2. Your account

You must be at least 18 and authorized to operate the restaurant you onboard. You are responsible for keeping your phone number secure — anyone with access to it can sign in via OTP. You are responsible for all activity under your account.

3. Your content + customer data

You own the restaurant data you enter (menu, sales, customer phone numbers, recipes). You are responsible for collecting customer data lawfully — including telling your customers why you collect their phone number and getting their consent before sending marketing messages. You grant us a license to store, process, and display this data solely to operate the service for you.

4. Pricing & billing

Subscription pricing and any usage-based charges (e.g. SMS, AI generation) are shown in your dashboard. Manual billing applies until automated billing is enabled. Non-payment may result in service suspension. Refunds at our discretion.

5. Acceptable use

  • Don't use the campaigns feature to send spam or unsolicited promotions.
  • Don't scrape, reverse-engineer, or resell the platform without permission.
  • Don't use the service for anything unlawful under Indian law.

6. AI features

AI outputs (menu scan extraction, dish-name translations, campaign message tuning) are generated automatically and may be inaccurate. Always review before relying on them. We are not liable for decisions you make based on AI suggestions.

7. Service availability

We aim for high uptime but do not guarantee uninterrupted service. We are not liable for losses arising from temporary outages, data loss, or third-party service failures (payment gateways, aggregator APIs, AI providers).

8. Termination

You may delete your kitchen at any time via Settings. We may suspend or terminate accounts that violate these terms, with notice where possible. On termination, your data is purged within 30 days unless retention is required by law.

9. Liability

To the maximum extent permitted by Indian law, MyGumasta's total liability for any claim is limited to the fees you paid us in the prior twelve months.

10. Changes

We will post material changes here. Continued use after a change constitutes acceptance. For breaking changes (e.g. price increases) we will notify you in-app at least 30 days in advance.

11. Governing law

These terms are governed by the laws of India. Disputes will be subject to the exclusive jurisdiction of the courts in your kitchen's state of registration.
